By accessing or using the Cognitron platform, you agree to comply with and be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use our services.

2. Description of Services

Cognitron provides a web-based cognitive assessment platform for research and clinical applications. Our services include:

  • Cognitive assessment paradigms and test batteries
  • Data collection, scoring, and analytics
  • Normative comparison datasets
  • Report generation and data export
  • Technical support and training

3. Account Registration and Use

3.1 Account Creation

You must create an account to use our services. You agree to:

All intellectual property rights in the Cognitron platform, including cognitive paradigms, algorithms, software, and documentation, are owned by Cognitron or our licensors. You receive only a limited license to use our services as described in your subscription agreement.

5.2 Your Data

You retain all rights to your assessment data. By using our services, you grant us a limited license to process your data to provide our services, generate reports, and create de-identified research datasets (where permitted).

6. Fees and Payment

Access to our services requires payment of applicable fees. You agree to:

  • Pay all fees according to your subscription agreement
  • Provide accurate billing information
  • Pay all applicable taxes
  • Maintain current payment methods

We may modify pricing with 30 days' notice. Failure to pay may result in service suspension or termination.

7. Data Protection and Compliance

For organizations subject to data protection laws:

  • HIPAA: Covered entities must execute a Business Associate Agreement
  • GDPR: Data processing is governed by our Data Processing Agreement
  • Research: Users must obtain required ethics approvals and informed consent

8. Disclaimers and Limitations

8.1 Service Availability

While we strive for high availability, we do not guarantee uninterrupted access. We may suspend services for maintenance or updates with reasonable notice.

8.2 Clinical Use

Our assessments are tools to support clinical decision-making. They should not be the sole basis for diagnosis or treatment decisions. Healthcare professionals must exercise independent clinical judgment.

8.3 Research Use

Researchers are responsible for:

  • Obtaining required ethics approvals
  • Obtaining informed consent from participants
  • Ensuring appropriate use of assessment data
  • Complying with applicable research regulations

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, COGNITRON SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, data, or business opportunities
  • Damages exceeding fees paid in the 12 months prior to the claim

10. Indemnification

You agree to indemnify and hold Cognitron harmless from claims arising from:

  • Your use of our services
  • Your violation of these terms
  • Your violation of any third-party rights
  • Your violation of applicable laws or regulations

11. Termination

We may suspend or terminate your access if you:

  • Violate these Terms of Service
  • Fail to pay applicable fees
  • Engage in fraudulent or harmful activities
  • Request account deletion

Upon termination, you must cease using our services. We will provide reasonable access to export your data.

12. Changes to Terms

We may modify these Terms of Service. Material changes will be communicated via email or platform notification at least 30 days before taking effect. Continued use after changes become effective constitutes acceptance.

13. Dispute Resolution

For any disputes arising from these terms:
